Edwards and its directors, officers, employees, affiliates, vendors, licensors and agents expressly disclaim all express and implied warranties, including, without limitation, warranties of merchantability, fitness for a particular purpose, and error-free and uninterrupted service.

b. A.G. Edwards and its directors, officers, employees, affiliates, vendors, licensors and agents will not be liable for any loss or damages incurred by you related to your use or attempted use of A.G. Edwards' client account access including damages caused by delays, errors, inaccuracies, unreliability, loss of data, or software restoration. A.G. Edwards will not be liable for any special, incidental, consequential, indirect or punitive damages, even if such damages were reasonably foreseeable.

This site may give you the ability to communicate electronically with A.G. Edwards through electronic mail (e-mail). You agree not to use e-mail to transmit orders to purchase or sell a security, to transfer or disburse funds, to transmit any personal credit information (including credit card numbers), or to give A.G. As a condition of your continued receipt of index data, you shall not create, sponsor or permit the trading on your exchange facilities, if any, of financial instruments or investment products (including, without limitation, derivatives, structured products, investment funds, exchange-traded funds or derivatives based on exchange-traded funds (e.g., options on ETFs or futures on ETFs)) where the price, return and/or performance of such instrument or product is based on, related to, or intended to track, any index or financial instrument or investment product (e.g., an exchange-traded fund) linked to an index, without a separate written agreement with the index publisher for such purpose.
